On co construction of "Shenzhen Hong Kong legal service deep cooperation zone"
Strategic framework agreement
Initiated by the Qianhai one belt, one road Legal Service Federation, and through consultation with all the legal professional organizations that have agreed to participate in the project, we have fully discussed the implementation of the "Qianhai Bay Macau Bay Area" construction plan, and promoted the construction of Shenzhen Hong Kong modern service cooperation zone. We have further deepened the deep cooperation of Shenzhen legal service, enhanced the ability of foreign legal services, and established an international legal service center and an international commercial dispute resolution center. They agreed to jointly promote the construction of "Shenzhen Hong Kong legal service in-depth cooperation zone". The "Shenzhen Hong Kong in-depth cooperation agreement" is concluded on the following matters:
First, the function of in-depth cooperation. The joint construction of the "Shenzhen Hong Kong deep cooperation zone in legal services" (hereinafter referred to as the "deep cooperation zone") is mainly promoted by the participation of legal professional organizations in Shenzhen and Hong Kong and other regions (including legal service industry associations and relevant professional service industry organizations, professional service statutory institutions, legal research and training institutions, the same below). The purpose is to provide legal professional service institutions Practitioners (including practicing lawyers and barristers, corporate legal affairs, arbitration, notarization, intellectual property services, accounting services, forensic services and other industries, the same below) engage in cross-border, cross industry, cross jurisdictional business and international legal affairs, provide a platform for exchange and cooperation, and create a mechanism for close cooperation.
Article 2 purpose of in-depth cooperation. One belt, one road, and one another, is to agree to uphold the concept of sharing and building together, and to mobilize resources for legal services in Shenzhen and Hong Kong and to create a cooperative mechanism of openness, tolerance, resource sharing, complementary advantages and mutual benefit.
Article 3 tasks and activities of in-depth cooperation. The parties agree that:
（1） Build a talent database of legal professional service institutions. All parties shall select and recommend high-quality resources, divide by region, industry and specialty, jointly build legal professional service institutions and talent resource databases in Shenzhen and Hong Kong and participating regions, and provide relevant information services for Shenzhen Hong Kong legal service industry cooperation and customers seeking legal services.
（2） Jointly build an international legal service center. One belt, one road, one side, the other is to build up a legal service cooperation, interaction and docking mechanism, give full play to the respective advantages of Shenzhen and Hong Kong legal services industry, and guide and promote the legal professional service institutions and practitioners in Shenzhen and Hong Kong and other regions. They will carry out collaborative, cross border, cross legal affairs and international legal affairs in the "cross the road" through various ways such as project docking, co operation, co operation, consultant recruitment, legal consultation and legal identification. Complementary and supporting case cooperation, mixed industry cooperation and service linkage, strengthen support and cooperation for small and medium-sized law firms in the two places, coordinate foreign-related legal service cooperation countermeasures, constantly expand cooperation space, innovate cooperation mechanism and jointly improve the level of international legal services.
（3） Jointly build an international commercial dispute resolution center. Taking advantage of the talent accumulation and complementary capabilities of Shenzhen and Hong Kong, the parties jointly promote the construction of commercial dispute mediation institutions and teams, support the establishment of Qianhai International Commercial Dispute Resolution Center, jointly improve commercial mediation rules, establish an exchange and mutual learning cooperation mechanism, strengthen the docking mechanism between commercial mediation, commercial arbitration and litigation, and explore ways to improve the level and implementation effectiveness of cross-border, cross jurisdictional and international commercial dispute mediation, Jointly promote the construction of international commercial dispute settlement center.
（4） Work together to promote the construction of the rule of law in Dawan district. All parties jointly provide legal support and services to promote the construction of a legal system suitable for the development of open economy in Dawan District, strengthen the construction of Qianhai socialist rule of law demonstration area, and promote legal and judicial exchanges and cooperation among Guangdong, Hong Kong and Macao by serving as legal (expert) consultants, providing advice, undertaking project entrustment and other means.

（6） Jointly promote the opening and cooperation of the legal service industry. The parties agree to assist each other in establishing diversified and close cooperation between the legal professional service institutions of the two places within the current policy and regulatory framework, deepen the implementation of open cooperation measures such as mutual establishment of branches, partnership (agreement) joint operation and mutual employment of legal advisers between Shenzhen and Hong Kong lawyers, and provide support and assistance for Shenzhen and Hong Kong legal service institutions to expand cross-border business, One belt, one road, is to explore the channels for the lawyers in Hong Kong and Macao to expand their professional qualifications and practice in the mainland, and to expand the channels and spaces for the lawyers in Hong Kong and Macao to play a role in the construction of the Tai Wan area and the "one belt and one Road".
（7） Build a mechanism for professional exchanges and mutual learning in legal services. According to the needs, all parties can jointly hold various forms of professional exchange activities (forums, seminars, lectures, argumentation, etc.) in due time, jointly form legal professional committees in various professional fields, carry out regular professional exchange and discussion activities, support the establishment of counterpart exchange and mutual learning mechanism among legal service industry associations and professional committees, and jointly build the (annual) Shenzhen Hong Kong Legal Service Cooperation Development Summit Forum.
（8） Jointly promote the training and exchange of legal professionals. According to the needs of cultivating high-end compound and international legal service talents in various places, we can carry out targeted training for legal service practitioners, jointly organize or provide lectures and training on legal professional issues, jointly hold special seminars, establish a mutual exchange mechanism for legal professionals in Shenzhen and Hong Kong, and assist in counterpart internships, research, visits and exchange activities for professionals.
（9） Jointly promote the establishment of cooperation and interaction mechanism with industrial and commercial associations and chambers of Commerce. All parties work together to expand strategic cooperation with Shenzhen and Hong Kong industry and commerce associations and chambers of Commerce, timely collect feedback and release the legal service needs of industry, commerce and enterprises, cooperate with the investigation of enterprises, especially the compliance operation of emerging business forms and risk prevention countermeasures, hold special lectures on methods and laws for enterprise executives and legal personnel as required, and support enterprises to strengthen the team construction of legal institutions, Promote the establishment of close and complementary cooperation between legal professional service institutions and corporate legal institutions.
（10） Jointly strive for the attention and support of government departments for the construction of in-depth cooperation zone. All parties should work together to offer advice and suggestions to the competent government departments on actively expanding and deepening the mutual opening and cooperation of Shenzhen and Hong Kong legal service industry, support the government departments to create a good legal environment for promoting the opening and cooperation of legal services, and strive for the policy support and financial support of the government departments for the construction of the deep cooperation zone.
（11） Other cooperation matters in the field of legal services deemed necessary by all parties.
Article 4 establish a strategic cooperation and consultation mechanism. The parties agree to establish an annual joint meeting mechanism to promote the construction of the deep cooperation zone, jointly discuss the annual work plan and major matters for the construction of the deep cooperation zone, and promote the establishment of a daily contact, communication and coordination mechanism for all parties.
All parties involved in the co construction have equal rights and responsibilities to participate in the co construction consultation, decision-making, implementation, supervision and proposal.
Article 5 jointly build a cooperative network service platform. The parties agree that one belt, one road Legal Service Association of Qianhai, will create a deep cooperation zone network service platform with the support of all sides, and provide legal service needs and cooperative project information services to legal professionals and practitioners in Shenzhen and Hong Kong, and establish a legal, service, online, offline, liaison, interaction and docking mechanism, and establish mutual legal consultation, identification and mutual assistance channels and mechanisms. Expand the provision of legal consultation, legal service supply and demand docking information and other services for society and customers, and constantly improve the service quality and efficiency of the network platform.
Article 6 permanent working organization for the construction of deep cooperation zone. The parties agreed that one belt, one road service association of Qianhai, should promote the construction and operation of the deep cooperation zone. The Secretariat of the Federation shall undertake the implementation organization, daily liaison, coordination and service of the annual work plan. Each participant shall designate a person in charge and a liaison to participate in and assist the work of the Federation and its Secretariat.
Article 7 arrangement of funds for the construction and operation of the deep cooperation zone. Qianhai one belt, one Road Federation, will raise funds for the construction and operation of the deep cooperation area through the support of all sides, social donations and government subsidies. The joint venture projects jointly funded by the parties concerned will be shared by the parties concerned and should be held separately by the request of one party. The funds are mainly for the requesting party.
Article 8 this Agreement shall come into force after being signed by all parties. The parties agree that this Agreement shall be valid for four years from January 1, 2019 to December 31, 2023. If this agreement needs to be modified within the term of validity, it shall be determined by both parties through negotiation and in writing. The extension or termination of this agreement after its expiration shall be determined by both parties through negotiation.
