    Guidelines on the procedure of accepting cases

    1、 Application for mediation

    If a commercial dispute cannot be settled through negotiation, one or both parties may apply to Shenzhen Qianhai international commercial mediation center (hereinafter referred to as "mediation center") for mediation.

    2、 Confirmation of mediation intention

    After receiving the application for mediation, the Secretariat of the mediation center shall consult the other party to decide whether to agree to mediation. In case of disagreement with mediation, the Secretariat shall notify the applicant and the mediation shall be terminated.

    3、 Acceptance and filing

    If the mediation center considers that it is in line with the requirements of mediation and filing, it shall accept the case, inform both parties of the mediation fees that should be paid, and issue a notice of filing payment. After the parties pay the mediation fees, they formally enter the mediation procedure.

    4、 Selection of mediators

    If both parties agree to mediate, the parties shall first select a mediator from the list of mediators in the mediation center to mediate; If both parties fail to choose or jointly entrust the Secretariat within the notice period, or fail to reach an agreement on the selection of a mediator, the Secretariat will appoint a mediator from the list of mediators of the mediation center for both parties to mediate according to the nature of the dispute.

    If the selected mediator is unable to mediate the dispute, the mediator shall be re selected in accordance with the provisions of the preceding paragraph.

    5、 To mediate

    The mediator shall organize both parties to mediate within 15 days based on the principles of convenience, quickness, impartiality and legality. If the mediation is successful, the reconciliation agreement shall be made; if the mediation is unsuccessful, the mediation termination agreement shall be made.

    6、 Notification of mediation results

    After mediation is completed, the mediator shall inform the Secretariat in writing of the result of the mediation.

    7、 The combination of mediation, judicial confirmation or arbitration award

    If a settlement agreement is reached through mediation, both parties may agree to submit the settlement agreement reached through mediation to the people's court with jurisdiction for judicial confirmation in accordance with the provisions of judicial confirmation, or contact an arbitration institution to make an award.
